Acceptable Use Policy
This Acceptable Use Policy ("AUP") explains permitted and prohibited uses of SwishTelecoms USA internet, VoIP, equipment, websites, and related services. By accessing or using our services, you agree to comply with this AUP.
This AUP is intended to help protect customers, our network, our service providers, and the public from illegal, abusive, harmful, fraudulent, or unreasonable activity.
1. Lawful Use Only
You may use the services only for lawful purposes and in compliance with applicable local, state, federal, and international laws, rules, and regulations.
Prohibited conduct includes, without limitation, using the services to engage in fraud, impersonation, harassment, threats, stalking, identity theft, unlawful interception, unlawful surveillance, or the creation, storage, transmission, or distribution of illegal content.
2. Network Security and Integrity
You may not use the services in a way that interferes with, disrupts, damages, degrades, or creates an unreasonable burden on our network, systems, platforms, equipment, or other users.
Prohibited activity includes, without limitation:
- Attempting to gain unauthorized access to systems, accounts, networks, or data
- Distributing malware, ransomware, spyware, viruses, worms, or other malicious code
- Launching or participating in denial-of-service attacks or other disruptive traffic activity
- Bypassing security controls, authentication measures, or service restrictions
- Using the service in a way that materially impairs network stability or performance
3. Prohibited Traffic, Abuse, and Excessive Use
Plans marketed for residential, personal, or standard business use may not be used for abusive, prohibited, or unauthorized high-volume activity that is inconsistent with the intended nature of the plan.
Unless expressly permitted by us in writing, prohibited activity may include:
- Operating public-facing servers intended for broad third-party access
- Open relays, proxy services, or anonymization services that facilitate abuse
- Bulk traffic generation or relaying that places unusual strain on the network
- Resale, sub-licensing, redistribution, or sharing of service outside the authorized account use
- Using a residential plan for prohibited commercial resale or carrier-style activity
Any references to unlimited or high-usage service remain subject to reasonable network management, this AUP, your plan terms, and lawful steps we may take to protect service quality and network integrity.
4. Spam, Unsolicited Messaging, and Calling Abuse
You may not use the services to send, transmit, distribute, or facilitate spam, unsolicited bulk communications, robocalls, auto-dialed campaigns, or other abusive or unlawful messaging activity.
This includes, without limitation:
- Bulk unsolicited email
- SMS or MMS spam
- Unlawful prerecorded or automated calls
- Caller ID spoofing or deceptive calling practices
- Messaging or calling activity that violates carrier, regulatory, or anti-spam rules
5. VoIP and Voice Service Restrictions
VoIP and voice services may be used only for lawful and authorized calling activity. You may not use voice services for fraud, traffic pumping, call masking abuse, unlawful robocalling, harassment, reselling without permission, or any usage pattern that threatens service integrity or creates abnormal risk.
We may monitor for unusual call activity, suspected fraud, excessive usage inconsistent with your plan, or activity that could harm service quality or violate law.
6. Intellectual Property and Content Misuse
You may not use the services to infringe the intellectual property, privacy, publicity, or other legal rights of any person or entity. This includes unauthorized copying, distribution, downloading, hosting, or sharing of protected content where prohibited by law.
7. Customer Responsibility for Devices and Accounts
You are responsible for activity that occurs through your account, credentials, equipment, or authorized devices, except to the extent caused by our error. You must take reasonable steps to secure your login credentials, local network, and connected devices.
8. Investigation and Enforcement
We may investigate suspected violations of this AUP and may take action we consider appropriate to protect our network, customers, partners, and legal interests.
Enforcement steps may include, without limitation:
- Warnings or notices
- Traffic filtering or temporary service restrictions
- Suspension of affected features or services
- Account suspension or termination
- Removal or blocking of harmful activity
- Referral to law enforcement, regulators, or other appropriate third parties where permitted or required by law
Where allowed by law and your plan terms, violations may result in suspension or termination without refund or with limited refund rights, depending on the circumstances and applicable policy.
9. Changes to This Policy
We may update this AUP from time to time. When we do, we will post the updated version on this page. Continued use of the services after an updated version becomes effective means you accept the revised policy, to the extent permitted by law.
