This Acceptable Use Policy (“AUP”) sets forth the terms under which customers and users (“Users”) of SwishTelecoms US, a division of Swish World Group Inc., may access and use the broadband, VoIP, and wireless internet services (“Services”). This AUP is designed to protect the integrity, reliability, and security of our network, ensure compliance with applicable laws, and foster responsible usage. By using our Services, you agree to comply with this AUP. Violation of this AUP may result in suspension or termination of Services.
2. Prohibited Activities
Users may not use the Services for any unlawful, harmful, or disruptive purposes, including but not limited to:
2.1 Illegal Use
- Engaging in any activity that violates applicable federal, state, or local laws and regulations, including copyright, trademark, and intellectual property laws.
- Transmitting, distributing, or storing child pornography or any other material that is illegal under U.S. law.
2.2 Network and System Security Violations
- Gaining unauthorized access to, or attempting to interfere with, SwishTelecoms’ network, systems, or customer accounts.
- Engaging in activities that disrupt or degrade network performance, such as Distributed Denial-of-Service (DDoS) attacks, hacking, or deploying malicious software (e.g., viruses, worms, or ransomware).
- Bypassing, modifying, or tampering with network security measures or monitoring tools.
2.3 Spamming and Unsolicited Communications
- Sending unsolicited bulk emails, spam, or chain letters.
- Engaging in email address harvesting or using our network to send phishing messages.
- Operating a mail server or service that allows open relay or sending of unsolicited messages.
2.4 Fraud and Identity Theft
- Impersonating another person or entity, or falsifying header information in emails or messages.
- Engaging in fraudulent financial activities, such as credit card fraud, identity theft, or pyramid schemes.
2.5 Copyright and Intellectual Property Violations
- Sharing, distributing, or downloading copyrighted material without authorization, including pirated software, movies, music, and books.
- Hosting or linking to sites that promote or distribute pirated content.
2.6 Excessive Use and Fair Usage Policy
- Consuming excessive network bandwidth in a manner that negatively affects other Users or the overall network performance.
- Running servers (including game servers, proxy servers, or file-sharing servers) on a residential broadband connection without prior authorization.
- Using the Services in a manner that circumvents bandwidth limitations or fair usage policies.
3. Enforcement and Remedies
SwishTelecoms reserves the right to investigate suspected violations of this AUP. If a violation is confirmed, we may take one or more of the following actions:
- Issue a warning to the User.
- Suspend or terminate Services without prior notice.
- Report unlawful activities to law enforcement or regulatory authorities.
- Take legal action as necessary to protect our network, Services, and Users.
4. Reporting Violations
To report a violation of this AUP, please contact us at abuse@swishtelecoms.com with relevant details, including logs, timestamps, and any supporting evidence.
5. Modifications to the AUP
SwishTelecoms reserves the right to modify this AUP at any time. Changes will be posted on our website at https://us.swishtelecoms.com. Continued use of our Services after modifications constitute acceptance of the updated AUP.
