Terms of Service

Effective Date: May 25, 2025

These Terms of Service ("Terms") govern your access to and use of SwishTelecoms USA services, including wireless internet, related equipment, websites, customer portals, and any optional voice or VoIP services we make available.

In these Terms, "SwishTelecoms," "we," "us," and "our" refer to Swish World Group Inc., doing business as SwishTelecoms in the United States. "You" and "your" refer to the customer, account holder, or user of the services.

1. Acceptance of These Terms

By ordering, activating, accessing, or using our services, you agree to these Terms, along with any other policies or disclosures that apply to your plan or service, including our Acceptable Use Policy, Privacy Policy, and any posted plan-specific terms.

If you do not agree to these Terms, do not use the services.

2. Eligibility and Account Information

You must provide accurate, current, and complete information when placing an order, creating an account, or requesting support. You are responsible for keeping your contact, billing, and service information up to date.

You are responsible for all activity that occurs under your account unless caused by our error.

3. Services

SwishTelecoms offers wireless broadband, related hardware, and optional voice or VoIP services. Service availability, speeds, features, device eligibility, and performance may vary based on plan, location, coverage, network conditions, equipment, building conditions, interference, and other factors outside our control.

We may update, improve, modify, suspend, or discontinue all or part of the services from time to time, including features, equipment models, or supported configurations.

4. Orders, Activation, and Service Availability

Submission of an order does not guarantee acceptance, activation, availability, or delivery timing. We may decline, delay, or cancel an order for reasons including service availability, payment issues, suspected fraud, identity verification, equipment availability, or policy violations.

Activation timing may vary. Estimated shipment, delivery, activation, or installation timeframes are not guaranteed.

5. Billing, Auto-Renewal, and Payments

Unless otherwise stated, services are billed on a recurring basis and automatically renew each billing cycle until canceled. By enrolling, you authorize us to charge your selected payment method for recurring service fees, applicable taxes, government-imposed fees, shipping charges, equipment charges, and any other amounts you authorize.

We aim to present recurring billing terms clearly and make cancellation reasonably accessible, but you are responsible for reviewing the plan terms and cancellation instructions that apply to your account. :contentReference[oaicite:2]{index=2}

6. Pricing, Taxes, and Fee Changes

Prices, promotions, service features, and included equipment may vary by plan, location, or promotional offer. Unless prohibited by law, we may change pricing or fees by providing notice as required by applicable law or your plan terms.

You are responsible for applicable taxes, surcharges, and government or regulatory fees, whether charged at the time of order or later assessed in connection with your service.

7. Refunds and Credits

Refund eligibility, credits, trials, guarantees, and return rights are governed by the specific offer you purchased and any posted refund or return policy. Unless a law, promotion, or written policy says otherwise, monthly service charges, partial-month usage, shipping charges, and used service periods may be non-refundable.

If you advertise or offer a guarantee, free trial, promotional refund right, or return window elsewhere on the site, those terms should be clearly disclosed and will control to the extent they apply. Clear disclosure of refund terms is important for consumer compliance and dispute reduction. :contentReference[oaicite:3]{index=3}

8. Cancellation

You may cancel service at any time using an approved cancellation method we provide, subject to any applicable plan-specific terms. Unless otherwise stated in writing, cancellation stops future recurring charges going forward and does not automatically create a refund for the current billing period or prior charges already incurred.

If you cancel, your service may remain active through the end of the then-current paid billing period unless your plan states otherwise.

9. Equipment

Some plans include, loan, lease, or sell equipment such as routers, adapters, or phones. Equipment treatment depends on your plan and order terms.

10. Acceptable Use and Network Protection

You agree not to use the services in violation of law, these Terms, or our Acceptable Use Policy. We may suspend, restrict, or terminate service to protect our network, comply with law, investigate misuse, address fraud or abuse, or enforce these Terms.

11. VoIP and Emergency Calling

If you use any VoIP or internet-based voice service we provide, that service may work differently from traditional telephone service. VoIP service depends on compatible equipment, electrical power, and a functioning internet connection.

Emergency calling may be subject to important limitations. Interconnected VoIP providers in the U.S. may have E911 obligations, but VoIP 911 calling can still differ from traditional landline emergency service and may be affected by outages, location registration, equipment issues, or power loss. Customers should review all 911 disclosures and keep location information accurate where required. :contentReference[oaicite:4]{index=4}

Do not rely on VoIP service as your sole means of contacting emergency services unless and until you have confirmed its availability, registration status, and limitations for your location and equipment.

12. Number Porting

If you request to transfer a phone number, porting is subject to eligibility, accurate account information, approval by your current provider, and any applicable technical or regulatory requirements.

We do not guarantee that every number can be transferred or that transfer will be completed within a specific time. You should not cancel your existing phone service until your transfer has been confirmed.

13. Service Interruptions and Performance

We do not guarantee uninterrupted, error-free, or continuously available service. Service may be affected by maintenance, congestion, weather, power loss, interference, third-party outages, upstream carrier issues, regulatory action, or events beyond our reasonable control.

14. Third-Party Services and Devices

Services may interoperate with or rely on third-party networks, equipment, software, content, or platforms. We are not responsible for third-party services, sites, devices, policies, outages, or compatibility limitations, even if they are mentioned on our site.

15. Warranty Disclaimer

To the fullest extent permitted by law, the services, website, and related equipment are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, except to the extent such warranties cannot be disclaimed under applicable law.

16. Limitation of Liability

To the fullest extent permitted by law, SwishTelecoms and its affiliates, officers, employees, contractors, licensors, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, data, goodwill, or use, arising out of or related to the services, equipment, website, or these Terms.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the services will not exceed the amounts you paid us for the affected service during the three (3) months immediately preceding the event giving rise to the claim.

17. Indemnification

You agree to defend, indemnify, and hold harmless SwishTelecoms and its affiliates, officers, employees, and agents from and against claims, liabilities, damages, losses, and expenses arising out of your misuse of the services, violation of these Terms, violation of law, or infringement of any third-party rights, except to the extent caused by our own misconduct.

18. Governing Law

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict of laws principles, except where federal law or other non-waivable law applies.

19. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated version on this page and revise the effective date above. Your continued use of the services after updated Terms become effective means you accept the revised Terms, to the extent permitted by law.
