These Terms of Service ("Terms") govern your access to and use of SwishTelecoms USA services, including wireless internet, related equipment, websites, customer portals, and any optional voice or VoIP services we make available.

If you request to transfer a phone number, porting is subject to eligibility, accurate account information, approval by your current provider, and any applicable technical or regulatory requirements.

We do not guarantee that every number can be transferred or that transfer will be completed within a specific time. You should not cancel your existing phone service until your transfer has been confirmed.

13. Service Interruptions and Performance

We do not guarantee uninterrupted, error-free, or continuously available service. Service may be affected by maintenance, congestion, weather, power loss, interference, third-party outages, upstream carrier issues, regulatory action, or events beyond our reasonable control.

14. Third-Party Services and Devices

Services may interoperate with or rely on third-party networks, equipment, software, content, or platforms. We are not responsible for third-party services, sites, devices, policies, outages, or compatibility limitations, even if they are mentioned on our site.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the services will not exceed the amounts you paid us for the affected service during the three (3) months immediately preceding the event giving rise to the claim.

17. Indemnification

You agree to defend, indemnify, and hold harmless SwishTelecoms and its affiliates, officers, employees, and agents from and against claims, liabilities, damages, losses, and expenses arising out of your misuse of the services, violation of these Terms, violation of law, or infringement of any third-party rights, except to the extent caused by our own misconduct.

18. Governing Law

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict of laws principles, except where federal law or other non-waivable law applies.

We may update these Terms from time to time. When we do, we will post the updated version on this page and revise the effective date above. Your continued use of the services after updated Terms become effective means you accept the revised Terms, to the extent permitted by law.
